Ditch Witch, Vermeer Reach Settlement with Earth Tool Co.

Earth Tool announced that a settlement has been reached between itself, the Charles Machine Works and Vermeer Corp. regarding litigation related to the purchase of ETC by CMW, manufacturer of Ditch Witch underground construction equipment, Trenchless Technology magazine reported last week.

Earth Tool announced that a settlement has been reached between itself, the Charles Machine Works and Vermeer Corp. regarding litigation related to the purchase of ETC by CMW, manufacturer of Ditch Witch underground construction equipment, Trenchless Technology magazine reported last week.

CMW announced last spring that it acquired 100-percent ownership of HammerHead Trenchless Equipment, manufactured by Earth Tool, which had a close relationship with Vermeer. Based on the terms of the settlement, Hammerhead Moles, HDD tooling and parts are now available through authorized Ditch Witch dealers worldwide. HammerHead Moles will also be available non-exclusively through Vermeer dealers for a period of two years, and HammerHead HDD tooling will be available non-exclusively through Vermeer dealers for three years, with parts available through Vermeer dealers for 15 years.

HammerHead ramming and bursting products are available through select authorized dealers, as well as direct from ETC. All HammerHead trenchless equipment will continue to be manufactured in Oconomowoc, Wis., where ETC’s headquarters are located.
