Walker Machinery Sues Construction Company for More Than $300,000

Cecil I. Walker Machinery Co., a Charleston, W. Va.-based Caterpillar dealership, is suing Poca, W.Va-based Waste-Tron and its president for failure to pay more than $300,000, according to West Virginia legal journal www.wvrecord.com.

According to the complaint filed Dec. 22 in Kanawha Circuit Court, Waste-Tron entered into a contract with Walker Machinery for the purchases of 10 pieces of heavy equipment. Walker Machinery claims Paul Saluja, Waste-Tron president, executed a note as co-maker with Waste-Tron for the purchase of the equipment. The unpaid balance was due and payable Feb. 27 of last year, but the defendants defaulted on the note, according to the lawsuit.

Waste-Tron and Saluja owe the payoff amount of $122,066.55 and has a balance in its open account of $226,218.71, after Waste-Tron maintained an open account between January and October, and was provided with various services, parts and rental equipment.

Walker Machinery is also seeking $122,066.55 in damages, plus re- and post-judgment interest for the equipment, plus the open balance. Waste-Tron has been named as a defendant in several similar suits in Putnam County, according to the news report.
